Terms of Service

These Terms of Service govern your use of the UA Construction website. By browsing the site, submitting an inquiry, or using any of its content, you agree to these terms. If you do not agree, please do not use the site.

The Website Is Informational

The site describes our services, our completed work, and our process. It is provided for general information only. Nothing on the site is a binding offer, a construction contract, a professional design service, or a promise that we will accept a particular project.

A construction relationship begins only when both you and UA Construction sign a written agreement that describes the scope, price, schedule, and terms for a specific project. Until then, no agreement exists between us, and either side may decline to move forward.

Estimates, Pricing, And Availability

Ranges, timelines, and figures shown on the site are general illustrations and are not quotes. A written estimate prepared for your project is based on the conditions we observed, the information you provided, and the selections that were known at the time.

Estimates are not open-ended offers. Unless the written estimate says otherwise, pricing may be adjusted if the scope changes, if concealed conditions are discovered once work opens a wall, floor, or site, if material costs move materially before purchase, or if code requirements differ from what was assumed. Allowance items in an estimate are estimates of cost, not caps.

Scheduling is subject to permit timing, material lead times, weather, site readiness, and the availability of trades. Dates discussed before a contract is signed are targets, not commitments.

Your Responsibilities

To build well we need timely decisions, access to the property, and accurate information. Where a project agreement applies, you agree to provide clear site access and legal authority to build on the property, to make selections and approve change orders within the agreed windows, to obtain or cooperate in obtaining any approvals only you can provide, and to keep the work area reasonably clear.

Delays or added costs caused by late decisions, undisclosed conditions, unavailable utilities, or access restrictions may affect the schedule and the price of the work.

Payments, Invoicing, And Lien Rights

Payment terms for a project are set in that project's written agreement, not on this website. Invoices are typically tied to progress milestones, and payment is due within the period stated on the invoice.

Under Kentucky law, contractors, subcontractors, and suppliers who furnish labor or materials for an improvement to real property may have lien rights against the property. Nothing on this site waives or limits those rights, and any notice or waiver is effective only when given in the form the law requires.

Returned payments, stop-work due to nonpayment, and the reasonable costs of collecting an unpaid balance, including attorney fees where the agreement or the law allows, may be charged as provided in the project agreement.

Workmanship Warranty

We stand behind the work we perform. Unless the project agreement provides otherwise, UA Construction warrants its own workmanship for one year from substantial completion against defects in installation, and will repair or replace defective work at no charge within that period.

Materials, appliances, fixtures, and equipment carry the manufacturer's warranty, which we will pass through to you. The warranty does not cover normal wear, movement or cracking caused by settlement that is within accepted tolerances, damage from water, weather, or neglect, work performed by others, alterations made after completion, or failures caused by a product we did not supply. Prompt notice of any concern is required so we can inspect it.

Homes For Sale And Project Listings

Homes shown as available are offered subject to prior sale, change, or withdrawal without notice. Details such as square footage, finishes, lot lines, school assignments, and completion dates are approximate and provided for convenience.

Listing information is not a solicitation for buyers already represented by another brokerage. All properties are offered without regard to race, color, religion, sex, disability, familial status, or national origin, as required by fair housing law.

Articles And Guidance

Articles on this site reflect general experience with homes in Central Kentucky. Building codes, permit requirements, inspection standards, and market conditions change, and they vary by jurisdiction.

Content on the site is not architectural, engineering, legal, tax, or financial advice, and it should not replace a professional evaluation of your property. Always confirm requirements with the authority having jurisdiction before relying on anything you read here.

Intellectual Property

The text, layout, photographs, drawings, renderings, logo, and other content on this site belong to UA Construction or are used with permission, and are protected by copyright and other laws.

You may view the site, print pages for your own non-commercial use, and share links to it. You may not copy, republish, or use our photographs or drawings in advertising, listings, or any commercial context without our written permission. Requests can be sent to our email address below.

Project Photography

We photograph completed work to document quality and to show future clients what a finished project looks like. Where a project agreement includes a photography provision, that provision controls. If you prefer that images of your property not be published, tell us and we will honor the request.

Acceptable Use

You agree not to interfere with the operation or security of the site, attempt to access areas or data you are not authorized to access, submit false or misleading inquiries, upload malicious code, scrape the site automatically, or use it to send unsolicited commercial messages.

We may restrict access to the site, or decline to respond to an inquiry, where we believe these terms have been violated.

Third-Party Links

The site links to services we do not operate, such as social media profiles and mapping tools. Those links are offered for convenience. We do not control their content, and we are not responsible for their accuracy, availability, or privacy practices.

Disclaimer Of Website Warranties

The site and its content are provided on an as-is and as-available basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, regarding the website itself, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Warranties for construction work are governed exclusively by the project agreement described above, and nothing in this section limits rights you have under Kentucky law that cannot be waived.

Limitation Of Liability

To the fullest extent permitted by law, UA Construction is not liable for indirect, incidental, special, consequential, punitive, or exemplary damages arising from your use of this website, from reliance on its content, or from any inability to access it, including lost profits, lost opportunities, or damage to data.

Nothing in these terms limits liability for fraud, willful misconduct, gross negligence, personal injury, or any other liability that cannot be limited by law.

Indemnification

You agree to indemnify and hold harmless UA Construction and its owners, employees, and agents from claims, losses, and reasonable costs, including attorney fees, that arise from your misuse of the site, your breach of these terms, or content you submit to us that infringes another party's rights.

Dispute Resolution And Governing Law

These terms are governed by the laws of the Commonwealth of Kentucky, without regard to conflict-of-law rules. Any dispute concerning this website that is not resolved informally will be brought in the state or federal courts located in Fayette County, Kentucky, and both parties consent to venue there.

Before filing a claim, please contact us with a written description of the problem and give us thirty days to respond. Most concerns are resolved in that conversation.

Claims relating to the construction of a project are governed by that project's written agreement, which may contain a different dispute-resolution process, including mediation or arbitration.

Changes To These Terms

We may revise these terms as our services and the law evolve. The revision date at the top of this page shows when the current version took effect, and the version in place when you use the site governs that visit.

General Provisions

If any provision of these terms is found unenforceable, the remaining provisions stay in effect. Our failure to enforce a provision is not a waiver of it. You may not assign your rights under these terms; we may assign ours in connection with a transfer of the business.

We are not responsible for delays or failures caused by events beyond our reasonable control, including severe weather, utility interruptions, labor disruptions, or shortages beyond our control. These terms, together with our Privacy Policy, are the entire agreement between us regarding use of the website.
